Rates & Locations for Labor Arbitrations
  1. A labor arbitration is conducted pursuant to a grievance or dispute arising under a collective bargaining agreement between an employer and a bargaining unit representative or union. Unless other arrangements are made prior to the hearing, this is the rates structure that will apply for labor arbitrations.
  2. The fee for each day of hearing is $975. The fee for study time and writing the opinion is $975 per day. Study time and writing the opinion is billed in half-day increments. One half-day is 3.5 hours.
  3. A cancellation/postponement fee of $500 per day will be charged for all scheduled hearing days if the hearing is cancelled or postponed within 30 calendar days prior to the day of the hearing. (The day of the hearing is not counted.)
  4. There is no travel charge for hearings that take place in the Dallas/Fort Worth area (Dallas, Tarrant, Denton and Collin Counties). If travel expenses are incurred (e.g., airplane, Uber/taxi, airport parking, hotel and meals) such expenses will be split among the parties. Travel expenses will be charged from the Arbitrator’s Fort Worth office address.
  5. If the hearing is cancelled or postponed, the parties are responsible for fees charged by a hotel for a cancellation beyond the deadline.
Rates & Locations for Employment, Commercial, Construction and any other Non-Labor Arbitrations
  1. These are the rates that will be charged for arbitrations conducted outside of the management/labor context in which there is no collective bargaining agreement between the parties. These are the rates that apply for Employment, Commercial, Construction or any other non-labor arbitrations.
  2. The fee for each day of hearing is $1,250. The fee for study time and writing the opinion is $1,250 per day. Study time and writing the opinion is billed in half-day increments. One half-day is 3.5 hours.
  3. A cancellation/postponement fee of $500 per day will be charged for all scheduled hearing days if the hearing is cancelled or postponed within 30 calendar days prior to the day of the hearing. (The day of the hearing is not counted.)

  6. The Arbitrator is willing to conduct pro bono arbitrations. Any party or parties wishing to have the Peña Arbitration & Mediation Group conduct a pro bono arbitration should contact Mr. Peña.
Rates & Locations for Mediations

Expedited 2-hour Mediation Session – This option is available for two-party cases (other than family law matters). Two-hour mediation sessions are charged at a rate of $325 per party (two-party cases only).

3- hour Mediation Session – This option is available for two-party cases (other than family law or multi-party disputes). The preferred times for scheduling these sessions are:

  • 10:00 a.m. to 1:00 p.m.
  • 1:00 p.m. to 4:00 p.m.
  • 2:00 p.m. to 5:00 p.m.

Three-hour mediation sessions are charged at the rate of $450 per party (two-party cases only).

4-Hour Mediation Session – This option is available for two-party cases and multiparty cases. The preferred times for scheduling these sessions are:

  • 9:30 a.m. to 1:30 p.m.
  • 2:00 p.m. to 6:00 p.m.

Subject to the needs of the parties, deviations from these preferred times can be scheduled, depending upon the Mediator’s schedule. Four-hour mediation sessions are charged at the rate of $575 per party.

Full-day Mediation Session – This option is available for two-party cases and multiparty cases. The Peña Arbitration & Mediation Group provides lunch for full-day mediation sessions. The preferred time for scheduling a full-day session is:

  • 9:30 a.m. to 5:30 p.m.

The Mediator is open to starting earlier or later, depending on the complexity of the case, the parties’ travel schedule or any other circumstances.

Full-day mediation sessions are charged at the rate of $1,200 per party. The Mediator is committed to working on the case after 5:30 p.m. and into the evening if necessary. The parties will not be charged for the first hour after eight hours. Additional hours after the eighth hour will be charged at the rate of $375 per hour to be split among the parties.

Payment – All mediation fees are due seven days prior to a scheduled mediation via credit card payment or law firm check. Checks are to be made out to The Peña Arbitration & Mediation Group.

Travel – The Peña Arbitration & Mediation Group does not charge for travel for mediations. For complex business or oil & gas disputes in locations more than 100 miles beyond Fort Worth, Texas, unless other arrangements are made, a travel per diem of not more than $75 per day may be charged. The Mediator will discuss the applicability of any per diem at the time of scheduling.

Cancellation Fees – The Peña Arbitration & Mediation Group will not charge cancellation fees for mediations cancelled at least 24 hours prior to the scheduled session. Cancellation fees for mediations less than a full day will not exceed $150; cancellation fees for a full day mediation will not exceed $300.
